THE LONG ISLAND PERMIT MAZE — EXPLAINED
Sidewalk Permit Long Island — ROW Guide
Long Island does not have a single countywide permit office. Permits are handled at the town, village, county, and state level — 148 separate authorities in all. Here is the complete map, and how we handle every one of them for you.
If a contractor tells you "we'll figure out the permit later," walk away. Long Island sidewalk work in the public right-of-way almost always requires a permit, and the wrong agency means the wrong application, the wrong fee, and a stop-work order. We handle every permit at every level — it's included in the estimate.
The 148 Long Island permit authorities
Nassau County has 3 towns (Hempstead, North Hempstead, Oyster Bay) and 64 incorporated villages, each with its own building department. Suffolk County has 10 towns, each with its own DPW or highway department. Nassau and Suffolk both have county-level DPWs for county roads. NYSDOT covers state highways. That is 148 separate permit authorities — and the right one depends on which road your sidewalk fronts.
| Permit Authority | Long Island Scope | What's Required |
|---|---|---|
| Nassau County DPW | Nassau County roads + ADA enforcement on all county routes. | Required for any work touching curbs, sidewalks, or aprons on Nassau County roads. |
| Town of Hempstead | Largest Nassau town — 800K+ residents, own building department and ROW process. | Town of Hempstead Building Department permit. |
| Town of North Hempstead | Plus 30+ incorporated villages each with own building department. | Town + village permits often both required. |
| Town of Oyster Bay | Gold Coast — Oyster Bay Highway Department + incorporated villages. | Highway Department ROW permit. |
| 64 Nassau villages | Each incorporated village (Garden City, Great Neck, Rockville Centre, etc.) operates its own building department. | Village-level permit on top of any town/county requirement. |
| 10 Suffolk towns | Babylon, Brookhaven, Huntington, Islip, Smithtown, Southampton, East Hampton, Riverhead, Southold, Shelter Island. | Each town DPW or highway department issues its own ROW permit. |
| Suffolk County DPW | Suffolk County roads — separate from town roads. | Suffolk DPW Right-of-Way permit. |
| NYSDOT | State highways and state routes — Sunrise Highway, Northern State Parkway frontages, NY-25, NY-27, NY-110. | Separate NYSDOT Highway Work Permit application. |
