Nassau County roads
If your property fronts a Nassau County road (Hempstead Turnpike, Old Country Road, Sunrise Highway service road in some sections, Merrick Road, etc.), the work requires a Nassau County DPW Right-of-Way permit. ADA is strictly enforced — non-conforming work must be removed and replaced within 48 hours of written notice.
Suffolk County roads
Suffolk DPW issues a separate ROW permit. Coastal towns layer additional environmental review on top, especially in the Pine Barrens and SCWA-protected aquifer zones.
Town roads
Each of Long Island's 13 towns (3 Nassau, 10 Suffolk) has its own highway department or DPW that issues permits for sidewalk work on town-owned roads. Hempstead, Oyster Bay, North Hempstead, Babylon, Brookhaven, Huntington, Islip, Smithtown, Southampton, East Hampton, Riverhead, Southold, Shelter Island.
Village roads
Nassau has 64 incorporated villages and Suffolk has 32. Each village operates its own building department and may require a separate permit on top of any town requirement. Garden City, Great Neck, Rockville Centre, Freeport, Patchogue, Port Jefferson — all separate processes.
State routes (NYSDOT)
Sunrise Highway (NY-27), Northern State Parkway frontages, NY-25, NY-110 and other state routes require an NYSDOT Highway Work Permit. These can take 30+ days — plan accordingly.
When you don't need a permit
Purely private walkway entirely on your own lot, not crossing the property line or affecting any curb cut: usually no permit. The moment you touch the curb, apron, or any portion of the public sidewalk: permit required.
